Me in a minute
I love the challenge of my specialist area and the strategic planning that is required at the outset of an arbitration/litigation case.
I am fascinated by historical battles and wars of the past, and I really do enjoy going in to battle for my clients, not only in court, but negotiating hard for them to secure the best possible outcome.
Indeed among the cases I enjoyed most there is a dispute pending before courts in Montreal and Milan where I used to act for Generali Assicurazioni concerning the insurance policy of banker Roberto Calvi. I also enjoyed assisting former RAS-Riunione Adriatica di Sicurtà SpA (Allianz Group) in another complex piece of litigation on: (i) a cross-border reinsurance case including the recovery of credits from HIH, the Australian insolvent retrocessionaire business; (ii) arbitration proceedings in the US for the termination of the reinsurance contract and damages claim; and (iii) against a British broker due to misrepresentations and non-disclosures of relevant information regarding the same reinsurance treaty before the Court of Milan.
I like viewing any single piece of litigation or arbitration as a piece of drama and taking account of the interpersonal dynamics that go hand in hand with the legal and commercial issues. But, what is most important is understanding what the best outcome looks like for the client. That may mean bringing someone to account in court, but it can also mean resolving a dispute through mediation and negotiation.
I do enjoy appearing before the Courts, however I am proud of my record in resolving many disputes through a more amicable settlement, and that is a key part of our ethos at Withers.
